By accessing or using the services provided by Appraiser Backup ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Services
Appraiser Backup provides research support services for licensed real estate appraisers, including comparable sales research, market data compilation, and related research deliverables. Our services are intended to support, not replace, the professional judgment of licensed appraisers.
3. Intellectual Property Rights
Proprietary Systems and Methods: All research methodologies, processes, systems, workflows, and business methods developed and used by Appraiser Backup constitute proprietary trade secrets and confidential business information owned exclusively by the Company.
Prohibited Activities: Customers and users expressly agree NOT to:
- Reverse engineer, decompile, or attempt to derive the underlying methods, processes, or systems used by Appraiser Backup
- Copy, replicate, or create derivative works based on our service model, workflows, or business methods
- Use information gained through our services to establish a competing business or service
- Share, distribute, or disclose our proprietary methodologies to third parties
- Reproduce or copy our website design, content, structure, or presentation

4. Customer Responsibilities
Customers are responsible for:
- Providing accurate property information for research requests
- Independently verifying all research data before use in appraisal reports
- Maintaining their own professional licensing and USPAP compliance
- Using our research as supporting data only, not as a substitute for professional judgment
5. Disclaimer of Warranties
Research deliverables are provided "as is" without warranties of any kind. While we strive for accuracy, Appraiser Backup does not guarantee that all data will be error-free or suitable for any particular appraisal assignment. Licensed appraisers remain solely responsible for the content and conclusions of their appraisal reports.
6. Limitation of Liability
Appraiser Backup's liability for any claims arising from our services shall not exceed the amount paid for the specific research package giving rise to the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.
7. Payment Terms
Payment is required at the time of order. All sales are final. Refunds are provided only at the Company's discretion if research cannot be completed as described.
8. Confidentiality
We treat all customer information and assignment details as confidential. Customer data will not be shared with third parties except as necessary to provide our services or as required by law.
9. Non-Compete and Non-Solicitation
By using our services, you agree not to solicit, recruit, or hire any employees, contractors, or service providers of Appraiser Backup for a period of two (2) years following your last use of our services.
10. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Wyoming.
11. Modifications
We reserve the right to modify these Terms at any time. Continued use of our services following any changes constitutes acceptance of the modified Terms.
